Acting Judge Thomas Masuku last week dismissed an application for absolution from the instance made by Erwin Spranger - a Swakopmund estate agent - who is facing a US$850 000 (Over N$12 million) lawsuit filed by the Democratic Republic of Congo armed forces head general Francois Olenga.

Spranger had submitted an application for the court to dismiss Olenga''s case, arguing that the general''s case was weak and that he had failed to make a prima facie case in the ongoing matter.

Judge Masuku requested the two parties to consult and set a date for hearing of the lawsuit. In his application, Spranger alleged that there was not enough evidence to proceed with the case.

Olenga is suing Spranger following a disputed transaction done about five years ago.

The army general is claiming that he paid about US$900 000 (equivalent to about N$6.78 million at the exchange rate at that time) to Spranger in September 2010.

Spranger allegedly failed and refused to repay all but only US$50 000 of that money paid to him by Olenga.

Olenga alleges that he transferred the money to Stranger''s estate agent at Swakopmund via a company registered in Delaware in the United States of America. The money was supposed to be used for the development of plots of land that he owned at the coastal town.

In a witness statement filed at the court, a bank official confirmed that bank records show that a total of N$6.78 million was paid into an account belonging to Stranger''s estate agent in five instalments from February to July in 2010. The payments were made from an American company that was registered in USA.

During an earlier testimony, Olenga told the court that he had instructed the American company to transfer US$900 000 into the trust account Stranger''s estate agent account. The money was supposed to be used to develop two plots he had bought at Swakopmund.
