Eight charges remain despite RCC acquittals
Three defendants who were jointly tried on 11 fraud charges regarding the B1 City development were acquitted on various counts in the Windhoek High Court yesterday.
Kelly Nghixulifwa, the former CEO of the Road Contractors Company (RCC), applied to be acquitted of all 11 charges, but was found not guilty on only three counts by Judge Christie Liebenberg.
He was acquitted of two charges of contempt of the Road Contractors Company Act and one charge of corruption.
Anna Ndoroma, who was a shareholder in Ae//Gams Engineering at the time of the alleged crimes, was acquitted of one count of fraud and one count of corruption.
The RCC was meant to complete the B1 City development in Windhoek with Ae//Gams Engineering.
Hafeni Nghinamwaami, who was a shareholder in Cradle Investments and who allegedly enriched himself through his relationship with Nghixulifwa, was also acquitted of one charge of fraud and one charge of corruption, but still faces an alternative of the corruption charge.
Other charges
Nghixulifwa still has to answer to four charges of corruption and four charges of fraud while Ndoroma now only has to face one charge of fraud. Nghinamwaami still faces the alternative corruption charge and two charges of fraud.
Nghixulifwa and Nghinamwaami are jointly facing a charge of fraud after they allegedly impersonated Nghinamwaami and Cradle Investments as a facilitator of the project and said he was entitled to a facilitator's fee of N$150 000.
The trial parties are expected to appear in court tomorrow to determine future court dates.
