Urgent application against ECN thrown out
The urgent application that the Christian Democratic Voice (CDV) filed against the Electoral Commission of Namibia (ECN) in the High Court in Windhoek was struck out from the roll today.
Viola Geirises brought the application, claiming the ECN failed to accept the party's notice of change in its authorised representative, as well as the subsequent submission of its candidate list. The ECN allegedly did not accept this list of candidates, because Gotthard Kandume had already submitted a list as the party's authorised representative.
Kandume claims to be the president of the CDV and says Geirises resigned from the party in July 2024 after the ECN deregistered the party. In response, Geirises argued that at the time she resigned only as the party's secretary general and not as a member of the party.
Yesterday, however, Judge Kobus Miller ruled that the application deals with party lists about the upcoming election and believes that "it is clearly an election issue".
"Jurisdiction in this case rests with the election court and not the high court," Miller said in his order, striking the case from the roll.
