#JustIn: Court orders ministry to pay inmate N$1 000
The High Court in Windhoek yesterday ruled that the ministry of home affairs, immigration, safety and security must pay N$1 000 in damages to a prisoner of the Hardap Correctional Facility.
This follows a lawsuit brought by the prisoner, Alexander Daniel van Schalkwyk, against the ministry and the Namibian Correctional Services (NSC). Initially, he demanded N$300 000 because members of the NSC destroyed his belongings, which was in violation of his constitutional rights.
While Van Schalkwyk's application was successful, the court decided that he did not determine the value of the belongings during the trial and therefore, the court had to decide on the value. The court ordered that the ministry only pay N$1 000. The belongings in question were wooden items that Van Schalkwyk made with the intention of selling them.
