JUST IN: RDP's urgent application fails in Electoral Court

The Rally for Democracy and Progress's (RDP's) urgent application in the Electoral Court was dismissed this morning after three judges ruled that the court did not have the jurisdiction to deal with the application.

The RDP, Hinananye Nehova, Ismael Frans, John Nghisekwa and Asser Sheuyange brought the urgent application against Mike Kavekotora, Kenedy Shekupakela, Nicanor Njdose, Cecil Nguvauva and the Electoral Commission of Namibia (ECN).

In the application, the RDP sought an interim interdict prohibiting Kavekotora, Shekupakela, Njdose and Nguvauva from accessing the RDP's bank account and further prohibiting them from holding any conferences or meetings regarding nominations for the national and presidential elections that will take place in November.

It was their request that the interdict remain in effect pending the determination of an appeal application brought by the RDP.

Judges Nate Ndauendapo, Kobus Miller and George Coleman agreed that the Electoral Court did not have jurisdiction because the application did not relate to the electoral law. The respondents' lawyer argued that the application should have been brought in the High Court instead.
