JUST IN: Couple fails in court battle for house
The Supreme Court today dismissed an application by a couple who’s house in Khomasdal was sold in execution in 2001.
Hewat en Erica Beukes wanted the rules of the High Court (rule 31(5)(a)) declared unconstitutional and have a default judgment granted by the registrar set aside in an attempt to regain possession of their house.
The judgment by judges Rita Makarau, Hannelie Prinsloo and Esi Schimming-Chase was delivered this morning.
