Dippenaar back in court for civil claim
Multimillion lawsuit set to start next month
Antonia Joschko sued convicted murderer Jandre Dippenaar for more than N$14 million following the death of her entire family in a car crash more than eleven years ago.
The civil case in which Antonia Joschko is claiming more than N$14 million in damages from convicted murderer Jandre Dippenaar continued with a status hearing yesterday. .
The parties appeared before Judge Shafimana Ueitele in the Windhoek High Court to establish the status of the case.
The trial was scheduled to begin on 5 March, with Joschko set to take the witness stand.
However, it is unclear whether the trial will start next week, considering recent developments such as Dippenaar’s sequestration and the withdrawal of his legal representative.
Joschko and Dippenaar are the only survivors of a horrific accident that occurred in December 2014, which was caused by Dippenaar.
Six people died in the accident. Joschko is the sole survivor in the vehicle in which she had been travelling with her father, Markus Joschko (48), her mother, Stephanie Schermuck-Joschko (49), and her sister, Alexandra Joschko (19).
Complications
Joschko filed the civil lawsuit against Dippenaar in 2017, claiming 714 991 euros (approximately N$13.7 million) and an additional N$500 000 in damages.
Since filing the case, Dippenaar has been found guilty on six charges of murder and was sentenced to 15 years in prison by the regional court in Swakopmund in August during the criminal trial.
However, he is now appealing both his conviction and sentence.
Dippenaar has also been sequestrated, with his liabilities exceeding his assets by just over N$328 500.
Furthermore, he has lost his legal representative. PD Theron & Associates submitted their notice of withdrawal to the court on 12 February.
“Given the circumstances, and due to the sequestration and the absence of a financial commitment from the defendant [Dippenaar], his legal practitioners had no other choice but to withdraw,” a report submitted to the court states.
Clerk to testify
According to court documents, a clerk from the magistrate's court in Swakopmund has been subpoenaed to testify in the High Court in Windhoek from 5 to 20 March.
Sandra Shikongo will testify on behalf of Joschko, and the court has asked her to bring a copy of the police file from the criminal case against Dippenaar. She is also required to bring a certified copy of the transcript from the criminal trial proceedings.
