#JustIn: Cape Cross Salt fails in court case against mining licence

Judge Nate Ndauendapo today dismissed an application in the High Court in which Cape Cross Salt challenged the award of a mining licence to Cape Cross Namib Investments.

Cape Cross Namib Investments was granted the licence in November 2009 and Cape Cross Salt’s application for a mining licence in the same area and for the same minerals were refused in June 2021.

Cape Cross Salt wanted the ministry of mines and energy to revoke the licence awarded to Cape Cross Namib Investments because the reward was allegedly orchestrated by the ministry and done in a manner that was non-compliant with the Act. Cape Cross Salt argued that the ministry has consistently shown bias towards Cape Cross Namib Investments.

They also alleged that no salt mining has been conducted since the licence was granted almost 10 years ago.

The court found that there was an unreasonable delay of over 10 years in launching the application and this makes the application grossly unreasonable.

The application was dismissed with costs.
