Bidder deemed ‘non-responsive’

The Central Procurement Board of Namibia (CPBN) has laid out in detail the reasons it disqualified a bid by Adaptive Building Land Construction for the construction of a water pipeline replacement stretching from Naute Dam to Keetmanshoop, as well as ancillary works.

The company submitted the bid alongside China State Construction Engineering Corporation in a joint-venture (JV) arrangement.

It follows a failed High Court bid on the part of the JV to overturn the CPBN’s awarding of the tender to another JV comprising JDN Civil Engineering and New Era Investment.

Outlining its reasons for the rejection, the CPBN said the bidder was deemed non-responsive and was disqualified from the bidding process.

“The bidder provided a reference letter for [a similar project it completed], however, the reference letter does not indicate the project value or give a brief description of scope of work done as required in the ‘Instruction to Bidders’,” the procurement board said in a notice.

The JV between Adaptive Building Land Construction and China State Construction Engineering Corporation further failed to provide specifics for similar but separate work it did on a Schwartzkuppe project.

“The bidder provided a reference letter and take-over certificate for the Schwartzkuppe project, but the reference letter does not specify the diameter of the pipe as required,” the CPBN said.

The High Court ruling cleared the way for the procurement board to award the bid to the JDN Civil Engineering and New Era Investment JV.

The contract is valued at N$184 million. This project has been described as critical to the livelihood of the Namibian population in the south, as the Naute Dam supplies water to the town of Keetmanshoop and the surrounding areas.
