Suspended Mukwaso demands to be reinstated

Suspended registrar of the Engineering Council of Namibia (ECN) Charles Mukwaso, claims that the council that met to decide on his suspension was not properly constituted and therefore acted unlawfully.

Mukwaso made the claims this week through his lawyer, Dirk Conradie, following his suspension over alleged misconduct claims.

In a letter to the ECN, Mukwaso accused the council’s president, Sophia Tekie, of fabricating evidence against him.

"The council has suspended our client on 31 May 2023 without compliance with the rules of natural justice and in respect of falsely fabricated evidence, which presently forms the subject matter of a criminal case under CR340/06/23 against Ms Tekie ," Mukwaso said through his lawyer, Conradie.

Unlawful decisions

Mukwaso additionally claimed that the council was not properly constituted and therefore acted unlawfully.

"The council as constituted by the present members is not lawfully constituted, and the terms of the office of the office bearers are consequently unlawful and of no effect in that they did not assume office in terms of Section 3(5) of the Engineering Act No. 18 of 1986," Conradie argued.

Mukwaso also demanded to be reinstated.

"We therefore demand from you, as we hereby do, that you allow our client to assume his duties as the registrar, as your actions of prohibiting him from performing his duties is unlawful as such as purported suspension ab initio void.”

Self-registration claims

Mukwaso is being accused of fraudulently registering himself as a professional engineer without the vetting of the council.

This follows a letter of suspension addressed to Mukwaso from council president, Tekie, in which he was accused of misconduct.

"Council, in an extraordinary meeting held on 31 May, duly resolved to temporarily suspend the registrar, engineer Charles Mukwaso, with full pay pending an investigation into various alleged misconduct," Tekie wrote in the letter dated 23 June.

Evidence fake

Mukwaso has denied the allegations and claimed that two letters that were written to announce his new designation as a professional engineer were fake and not written by him.

"I am the registrar of the ECN, overseeing all operations, and I have been able to identify the two letters as fake and fraudulent. Both letters bear the letterhead that was phased out in 2019. Both letters are not stamped – they do not bear the official stamp of the engineering council," Mukwaso said in a police statement.
