Hatuikilipi takes another aim at freedom

The State is accusing Tamson Hatuikulipi of abusing the court process after his latest bail application this week.

Hatuikulipi, who already had two unsuccessful bail attempts, told the Windhoek High Court in his recent bail bid that his prolonged incarceration has adversely impacted his financial position. He further claimed that he has accumulated many debts during the process.

He said this yesterday when he presented what he considered new facts before Judge David Munsu. But state prosecutor Hesekiel Iipinge argued that Hatuikulipi’s latest bid did not come with any new facts as he claimed, despite the latter saying he can prove with evidence that the new details were not provided in his last bail application.

Iipinge argued yesterday that Hatuikulipi's attempt to secure bail is merely an amplification of his previous applications, under the pretense of presenting new facts.

Hatuikulipi, who has been in custody for nearly four years, is filing his third bail application based on these purported new facts.

According to Iipinge, however, his deteriorating financial situation and emotional detachment from his children were pre-existing facts at the time of his second bail application, factors considerably dealt with when that application was dismissed.

In addition, Hatuikulipi said it has been a year and five months since his last bail application and has since not lodged another case, which the State strongly holds as a pre-existing fact, a natural consequence of the court refusing to grant him bail.

The bail application will be heard over three days.
